Foreclosure

Chicago Foreclosure Lawyers

More and more Americans are suffering through the foreclosure process. Many people have lost their jobs, can’t find a new one and are now losing the home that they love. You may feel overwhelmed, embarrassed and unsure of how to proceed. Our expert foreclosure attorneys will guide you through the process and help you to keep your home.

Foreclosure summonses are issued when a homeowner has been fallen behind on their mortgage payments. The mortgage lenders will take ownership of your home and sell it at an auction to try to recoup some of their loan. Once you have received a summons, you typically have 6-7 months to try to stop your home from being sold at an auction. The foreclosure process is taken care of through the courts in Illinois. Once the homeowner was unable to make a payment, their lender can file a Complaint to Foreclosure Mortgage, which gives the homeowners a month to reply. The homeowners will be given 3 months to pay off their mortgage if the court was in agreement with the lender, and if payment is not received, the house will be sold.

Chapter 13 bankruptcy helps to stop foreclosure. If you decide to file for Chapter 13, in order to keep your home, you will need to eventually pay back what you owe with a payment plan. A convenient monthly payment plan will be established, and it will combine what your current monthly mortgage payment is with your back payment. You will have between 36-60 months to pay back your mortgage debt.
